Generator Supercenter 20th Anniversary Drawing

 

Generator Supercenter is celebrating its 20th Anniversary with a $20,000.00 drawing for employees!  We will award 10 prizes of $2,000 each to 10 employees.  Employees will receive entries based on years of service (one entry for each completed or partial year).  The longer your tenure, the more chances you will have to win.  To spread the winnings across the company, each Employee will only be eligible to win once.  Employees must be employed on the date of the drawing and in good standing with the company as of the date of the drawing to be eligible.

Give Away Terms and Conditions (a/k/a the “Fine Print”)

 

BY ENTERING THE DRAWING EMPLOYEE AGREES TO BE SUBJECT TO THE TERMS SET FORTH BELOW.

Definitions:  GSC shall mean Generator Supercenter, Inc.  Employee shall mean an individual employed by GSC on a full-time or part-time basis under an at-will employment arrangement.  Contractors, temporary workers, and other individuals are not considered Employees. 

Prizes:  As noted above, GSC will award 10 prizes of $2,000.00 each to 10 Employees who fulfill all the conditions of eligibility set forth herein and whose names are drawn as winners across the names of all the entries from all the Employees of GSC who participate in the drawing. 

Payment:  Employees receiving prizes will receive payment within two payroll cycles (GSC may not have time to get the relevant information into its payroll system in time for the payroll cycle immediately following the drawing).  Payment will be delivered with each winner’s regular paycheck, delivered by whatever mechanism the Employee has selected with the GSC’s payroll department for regular payroll.

Taxes:  Inasmuch as GSC would like to offer these prizes without tax, the government requires the company to collect taxes on drawing winnings.  GSC will, however, gross-up the drawing winnings to cover the taxes based upon the Employee’s W-4 on file with the company as of the date of the drawing. 

GSC Employee Eligibility:  All Employees of GSC as of the date of the drawing who are in good standing with the company as of the date of the drawing shall be eligible to participate in the drawing.  An Employee’s good standing shall be determined by the Employee’s supervisor, in their sole discretion.

 

Number of Wins:  Each Employee will be eligible to receive one prize.  If an Employee’s name is drawn more than once, GSC will give the Employee acknowledgement for their good fortune (but no additional prize).  Additional names will be drawn until a person has not yet received a prize wins.  In the extremely unlikely event that all participating Employees receive a prize, a bonus round of additional drawings will be conducted to determine a second chance for all winners to receive a prize restarting the drawing process from the beginning.

Drawing Process:  The drawings will be completed in a live event conducted under the supervision of Matthew Metcalfe and witnessed by a third-party non-Employee for verification purposes. 

Notification:  Though everyone is encouraged to tune in for the drawing event, GSC acknowledges that not all Employees will be able to do so.  Employees who receive an award will be notified by email within 24 hours of completion of the drawing.

Entries \ Years of Service:  Years of service will be determined based on Employee anniversary beginning on the first anniversary of hire with a year added for the current incomplete year of service.  By way of example, an Employee hired in December 2020 would receive five entries – one for each completed year and one for the incomplete portion of 2025. 

Right of Refusal \ Donation:  Employees may choose not to participate in the drawing for any reason.  Employees wishing not to participate should make their request know to Erica Escamilla by email to [email protected] on or before September 15, 2025.  Employees who receive a prize, may decline the prize after receipt by suggesting a charity or co-worker for the prize in their stead.  These decisions will be confidential.  In the event a prize is unclaimed, GSC will donate the prize money to an appropriate charity.

Unexpected Developments:  GSC has tried to anticipate most of the possible hang-ups or issues that might arise as part of the drawing.  Unfortunately, GSC is not clairvoyant and cannot think of everything.  In the event of something unexpected, GSC will defer to Matthew Metcalfe to make the best decision he can for everyone.  All Employees who choose to participate in the drawing agree that Matthew Metcalfe shall be the final arbiter of the rules for the drawing and shall resolve any uncertainty in his sole discretion.

Disputes:  If any dispute arises between any Employee and GSC as a result of the drawing, each party agrees to take the dispute to arbitration before a single independent arbitrator (but not AAA).  The parties agree that arbitration shall be conducted under the Federal Arbitration Act.

Applicable Law, Forum, and Venue:  Any dispute concerning the drawing shall be governed and construed exclusively in accordance with the laws of the State of Texas without regard to the conflicts of laws or principles thereof.  Employee and GSC agree that Texas shall be the forum for any action or suit related to this Agreement, including, but not limited to, any claim affecting its validity, construction, effect, performance or termination.  GSC and Employee further agree that the venue for any such action or suit which is not required to be arbitrated under this Agreement shall exclusively be the state or federal courts sitting in Harris County, Texas.

Winner’s List:  Even though this is not a formal legal “sweepstakes,” GSC will provide a winner’s list to any Employee who misses the live stream event.
